Amending Your Will

As your personal circumstances change during the course of your life then it is important to review your Will to ensure that it reflects your current circumstances.

WHEN SHOULD I CHANGE MY WILL?

You should consider reviewing your Will to amend or make a new Will upon the occurrence of Key Life Events such as:-

  • Marriage/Civil Partnership
  • Separation
  • Divorce
  • Birth of a Child
  • Death of a Relative
  • Buying your First Home
  • Moving Home
  • Change in Financial Circumstances
  • Starting a Business

Or you might want to change the Will because you want to

  • Add any beneficiaries not included in the existing Will
  • Appoint new Executors
  • Appoint a new Trustee
  • Protect loved ones
  • Increase protection against tax liabilities

Major events like those set out above may impact the distribution of your assets and/or your most recent wishes not being correctly reflected, as well as the risk that key events may impact the validity of your existing Will.

HOW TO CHANGE YOUR WILL

There are only two ways in which a Will can be changed which are either:-

  • Creating a Codicil to an existing Will, or
  • Creating a completely new Will

It is not possible to write on the existing Will to make changes. A Will cannot be amended after it has been signed and witnessed. Any such amendments will not be valid as they did not form part of the original legally valid Will

NEW WILL OR CODICIL?

Generally speaking, if you make a small change or simple amendment then you can use a Codicil which is kept with the original Will.
However, if the changes are more complicated and significant or if the original Will is no longer valid then we recommend you make a new Will.
